The New Residence Card - confirming your rights after Brexit

You may have already heard about the new Residence card that is being issued in Spain to British expats, its the 'Tarjeta de Identidad de Extranjero' or TIE for short.

For existing Residents this is a replacement for the old green residencia card or paper certificate in light of of the Brexit 'Withdrawal Agreement' which preserves expat residents the right to free movement, access to work and healthcare provision in Spain.  The new card confirms these rights and as its biometric using a fingerprint and a photo it can be used as a full identity card in Spain alleviating the need for having to use your passport as identification.  In fact many official places are now asking for the TIE rather than a passport so although current residents cards will still be valid some offices may be reluctant to accept them.  As such we would recommend you update to the new card as soon as possible for peace of mind and practicality.

If you are a Non Resident intending to apply for residency in Spain then you will need to act quickly as the deadline for new applications for the TIE to retain your rights under the Withdrawal Agreement is 31st December 2020.  This means actually getting an appointment in Almeria by that date and with the huge demand likely for these cards that may well be difficult.
However, as a registered solicitor we can not only assist you with the completion of the necessary forms but also apply before the deadline on your behalf such that when an appointment does become available they will recognise that the application was registered before the deadline.
Failure to apply for Residence before the 31st December 2020 will make it a far more involved matter after that date and Residency and your rights may not be guaranteed.

We know that some people may wish to pay for a translator to not just help with the forms but also attend the government offices with them but its worth noting that currently the offices are only allowing one person at a time due to Covid-19 precautions so this would be an unnecessary expense.  We can not only assist with the forms but also register your application so if necessary it is before the deadline - all for a small nominal fee.  All you will then need to do is pop down to Almeria to provide your fingerprint once we have the appointment.
